A Legal Analysis of the Appointment of the Executive Board of the Honduran National Congress

Abstract

This article examines from a constitutional perspective and, in light of current positive law, whether the process for appointing the Executive Committee of the National Congress is based on legal grounds. An exclusively legal approach is employed, evaluating the degree of constitutionality in the election and appointment of the Executive Board for the 2022–2026 legislative term; and how this phenomenon, in the author’s view, adds to the list of events that have weakened the rule of law in Honduras. As a result of the meticulous analysis conducted, the article concludes that this appointment was carried out in a manner contrary to the provisions of the Constitution and the law. The conclusions and recommendations aim to raise civic awareness regarding the inescapable obligation to defend, strengthen, and uphold the Constitution and the rule of law in the country.
